Klauzula Informacyjna
Wypełniając obowiązek informacyjny wynikający z Rozporządzenia Parlamentu Europejskiego i Rady (UE) 2016/679 z dnia 27 kwietnia 2016 r. w sprawie ochrony osób fizycznych w związku z przetwarzaniem danych osobowych i w sprawie swobodnego przepływu takich danych oraz uchylenia dyrektywy 95/46/WE („RODO”), informujemy że:
1. Dane osobowe Wnioskodawców przetwarzane są przez Dysponenta Funduszu Sprawiedliwości – Ministra Sprawiedliwości, Wykonawcę oraz wskazany Ośrodek/Punkt Pomocy Pokrzywdzonym, w zakresie wymaganym do udzielenia pomocy ze środków Funduszu Sprawiedliwości.
2. Przetwarzanie danych osobowych będzie się odbywać w celu realizacji i rozliczenia pomocy udzielanej osobie pokrzywdzonej przestępstwem, świadkowi lub osobie najbliższej ze środków Funduszu Pomocy Pokrzywdzonym oraz Pomocy Postpenitencjarnej – Funduszu Sprawiedliwości na podstawie § 38 Rozporządzenia Ministra Sprawiedliwości z dnia 13 listopada 2024 r. zmieniające rozporządzenie w sprawie Funduszu Pomocy Pokrzywdzonym oraz Pomocy Postpenitencjarnej - Funduszu Sprawiedliwości (Dz.U. 2024 poz. 1715).
3. Do przetwarzania danych osobowych może dojść także w sytuacji korespondencji elektronicznej z Wnioskodawcą, w szczególności dotyczy to adresu poczty elektronicznej Wnioskodawcy.
4. Przetwarzanie danych osobowych wymaga wyrażenia zgody przez Wnioskodawcę.
5. Dane osobowe przetwarzane będą na podstawie Rozporządzenia Parlamentu Europejskiego i Rady (UE) 2016/679 z dnia 27 kwietnia 2016 r. w sprawie ochrony osób fizycznych w związku z przetwarzaniem danych osobowych i w sprawie swobodnego przepływu takich danych oraz uchylenia dyrektywy 95/46/WE (ogólne rozporządzenie o ochronie danych), w szczególności art. 6 oraz art. 7 rozporządzenia; ustawy z dnia 6 czerwca 1997 r.; celem realizacji interesu prawnego wynikającego z ustawy z dnia 6 czerwca 1997 r. Kodeks karny wykonawczy (t.j. Dz. U. z 2018 r. poz. 652, z późn. zm.) – w szczególności art. 43 – dotyczącego Funduszu Sprawiedliwości oraz rozporządzenia Ministra Sprawiedliwości z dnia 13 września 2017 r. w sprawie Funduszu Pomocy Pokrzywdzonym oraz Pomocy Postpenitencjarnej – Funduszu Sprawiedliwości ( z późn. Zm.) – w szczególności Działu V rozporządzenia.
6. Współadministratorami danych osobowych są:
1) Dysponent Funduszu – Minister Sprawiedliwości, Al. Ujazdowskie 11, 00-950 Warszawa P-33;
2) Wykonawca - Iwo-Doradztwo Obywatelskie, ul. Bolesława Prusa 145/G, 33-300 Nowy Sącz.
7. Inspektorem Ochrony Danych w Ministerstwie Sprawiedliwości jest pani Katarzyna Borys. Dane kontaktowe: Ministerstwo Sprawiedliwości, Al. Ujazdowskie 11, 00-950 Warszawa, email:
8. Dane osobowe, na podstawie ustawy z dnia 14 lipca 1983 r. o narodowym zasobie archiwalnym i archiwach (Dz.U. z 2018 r. poz. 217), będą przechowywane przez okres wynikający z przepisów prawa oraz będą archiwizowane zgodnie z regulacjami obowiązującymi w Ministerstwie Sprawiedliwości.
9. Wnioskodawcy przysługują następujące prawa związane z przetwarzaniem danych osobowych:
1) prawo wycofania zgody na przetwarzanie danych,
2) prawo dostępu do danych osobowych,
3) prawo żądania sprostowania danych osobowych.
Aby skorzystać z powyższych praw, należy skontaktować się z inspektorem ochrony danych.
10. Prawo wycofania zgody: w zakresie, w jakim dane są przetwarzane na podstawie zgody Wnioskodawca ma prawo wycofania zgody na przetwarzanie danych w dowolnym momencie. Wycofanie zgody nie ma wpływu na zgodność z prawem przetwarzania, którego dokonano na podstawie zgody przed jej wycofaniem. Zgodę można wycofać poprzez wysłanie oświadczenia o wycofaniu zgody na wskazany wyżej adres korespondencyjny.
11. Prawo wniesienia skargi do organu: wnioskodawcy przysługuje prawo wniesienia skargi do organu nadzorczego zajmującego się ochroną danych osobowych, tj. Prezesa Urzędu Ochrony Danych Osobowych, adres do korespondencji: Biuro Prezesa Urzędu Ochrony Danych Osobowych (PUODO), ul. Stawki 2, 00-193 Warszawa.
12. Dane osobowe Wnioskodawcy nie będą przetwarzane w sposób zautomatyzowany i nie będą profilowane.
