The victims of crime can use electronic counseling in three cases:

  • the victim is abroad and cannot go to the local Victim Assistance Center
  • the victim is disabled and has trouble getting to the local Victim Assistance Center
  • the lawyer during telephone duty stated the necessity to send documents for further consideration

Information Clause

By fulfilling the information obligation arising from Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46 / EC (" GDPR "), please be informed that:

  1. The controllers of personal data are:

  2. Applicants' personal data will be processed by the Dispatcher of the Justice Fund - the Minister of Justice, the Contractor and the designated Center / Assistance Center for Victims, to the extent required to provide assistance from the Justice Fund.
  3. Personal data will be processed on the basis of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46 / EC (general regulation on data protection), in particular art. 6 and art. 7 of the Regulation; the Act of June 6, 1997 to implement the legal interest arising from the Act of June 6, 1997, the Executive Penal Code (i.e., Journal of Laws of 2018, item 652, as amended) - in particular art. 43 - regarding the Justice Fund and the Regulation of the Minister of Justice of September 13, 2017 regarding the Victim Aid Fund and Assistance

Post-Penitentiary - Justice Fund (Journal of Laws of 2017, item 1760) - in particular Section V of the Regulation.

  1. Personal data will be processed for the purpose of consideration, implementation and settlement of assistance provided to the victim of a crime, a witness or the closest person from the funds of the Victim Assistance Fund and Post-Penitentiary Assistance - the Justice Fund pursuant to § 38

Ordinance of the Minister of Justice of September 13, 2017 regarding the Victim Aid Fund and Post-Penitentiary Assistance - Justice Fund (Journal of Laws of 2017, item 1760).

  1. Providing data is a prerequisite for providing assistance from the Justice Fund in the form of directing the Applicant to the Victim's Center / Assistance Point. The processing of personal data may also occur in the event of an exchange of electronic correspondence with the Applicant, in particular this applies to the Applicant's e-mail address
  2. The processing of personal data requires the consent of the Applicant.
  3. Personal data will be stored for the period resulting from legal provisions and archived in accordance with the regulations in force at the Ministry of Justice on the basis of the Act of 14 July 1983 on the national archival resource and archives (Journal of Laws of 2018, item 217) .
  4. The applicant has the right to request the administrator to access his personal data, rectify it, delete or limit processing, object to the processing, as well as transfer data and withdraw his consent to the processing of personal data and he has the right to lodge a complaint with the President of the Office Data Protection
