INFORMATION CLAUSE

In fulfilment of the information obligation arising from Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (“GDPR”), we hereby inform you that:

1. The personal data of the Applicants are processed by the Administrator of the Justice Fund – the Minister of Justice, the Contractor, and the designated Centre/Point for Assistance to Victims of Crime, to the extent necessary to provide assistance from the resources of the Justice Fund.
2. Personal data shall be processed for the purpose of providing and accounting for assistance granted to a person harmed by a criminal offence, a witness, or a close person from the resources of the Fund for Assistance to Victims of Crime and Post-Penitentiary Assistance – Justice Fund, pursuant to § 38 of the Regulation of the Minister of Justice of 13 November 2024 amending the Regulation on the Fund for Assistance to Victims of Crime and Post-Penitentiary Assistance – Justice Fund (Journal of Laws 2024, item 1715).
3. Personal data may also be processed in connection with electronic correspondence with the Applicant, in particular the Applicant’s e-mail address.
4. The processing of personal data requires the Applicant’s consent.
5. Personal data shall be processed on the basis of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), in particular Articles 6 and 7 thereof; the Act of 6 June 1997; for the purpose of pursuing the legal interest arising from the Act of 6 June 1997 – Executive Penal Code (consolidated text: Journal of Laws of 2018, item 652, as amended), in particular Article 43 concerning the Justice Fund; and the Regulation of the Minister of Justice of 13 September 2017 on the Fund for Assistance to Victims of Crime and Post-Penitentiary Assistance – Justice Fund (as amended), in particular Chapter V of the Regulation.
6. The joint controllers of the personal data are:
   1. Administrator of the Fund – Minister of Justice, Al. Ujazdowskie 11, 00-950 Warsaw P-33;
   2. Contractor – Iwo-Doradztwo Obywatelskie, ul. Bolesława Prusa 145/G, 33-300 Nowy Sącz.

8. Pursuant to the Act of 14 July 1983 on the National Archival Resources and Archives (Journal of Laws of 2018, item 217), personal data shall be stored for the period resulting from applicable legal provisions and shall be archived in accordance with the regulations applicable at the Ministry of Justice.

9. The Applicant has the following rights in relation to the processing of personal data:

   1. the right to withdraw consent to the processing of data;
   2. the right to access personal data;
   3. the right to request rectification of personal data.

   To exercise the above rights, the Applicant should contact the Data Protection Officer.

10. Right to withdraw consent: to the extent that the data are processed on the basis of consent, the Applicant has the right to withdraw consent to the processing of data at any time. Withdrawal of consent shall not affect the lawfulness of processing carried out on the basis of consent before its withdrawal. Consent may be withdrawn by sending a declaration of withdrawal of consent to the correspondence address indicated above.
11. Right to lodge a complaint with a supervisory authority: the Applicant has the right to lodge a complaint with the supervisory authority responsible for the protection of personal data, i.e. the President of the Personal Data Protection Office, correspondence address: Office of the President of the Personal Data Protection Office (PUODO), ul. Stawki 2, 00-193 Warsaw.
12. The Applicant’s personal data shall not be processed by automated means and shall not be subject to profiling.
